The following terms and conditions apply to your use of the Octagon Electronics - Australia web site by Octagon Electronics Pty Ltd(Australian Business Number) ABN 26 131 991 823, (herein after referred to as Octagon Electronics) and its customers. Your use of the web site indicates your acceptance of these terms and conditions. These terms and conditions are subject to change by Octagon Electronics and the content may be changed at any time without any prior notice to anyone.

ORDERING

1.You can purchase the products in our store, or over the phone,fax,email .

2. Orders placed through our website are subject to verification and acceptance by Octagon Electronics. Without prior notice or warning Octagon Electronics may change its published prices on this website at any time and we accept no liability for their variants and changes.

2. Quotation made by Octagon Electronics is not an offer to sell and no order given in pursuance of any quotation shall bind the company unless accepted by it. All orders are subject to acceptance by Octagon Electronics within Five(5) business days of receipt of the customer's offer.

3. Delivery fees may vary depending upon location  and other logistical requirements.Octagon Electronics reserves the rights to adjust freight cost at any time.

4. Octagon Electronics reserves the right to reject or suspend any error order.

5. Any terms and conditions are subject to change by Octagon Electronics and the content may be changed at any time without any prior notice to anyone.

PRODUCT INFORMATION, PRICES & PICTURES VARIATIONS

Prices and ranges available on our website may differ to our Shop. Octagon Electronics makes every effort to keep our product pictures and specifications up-to-date. However, our picture or description of the goods may differ from the actual goods we sell and stock in our store. We accept no liability or accountability for this variation as this is normally due to conditions that are out of our control 

PRICES

All prices in the website are in Australian Dollar which includes GST

PAYMENT

When you make your order you agree to make full payments for the goods you have ordered including delivery and handling charges specified on Octagon Electronics’ website. We cannot release or send ordered goods (except COD) until the payment process is finalised and complete, please contact us if you are having trouble with your payment.

DELIVERY

 We will do our best to make sure your goods arrive in good condition and a timely manner.

1. Our products' price do not include delivery charges.  delivery fee varies depending on location and quantity of goods you have ordered.

2. Shipping and handling costs are not refundable.

3.  We do not ship internationally and PO BOX address.  We do not ship to third party addresses unless that address is known and can be verified by Octagon Electronics.

4. The Customer shall at its own expense, arrange collection of products from Octagon Electronics at its premises. Alternatively, Octagon Electronics in its sole and absolute discretion may arrange physical delivery of products to the Customer at the Customer's business address, such delivery being at the cost of the Customer. The Customer shall be deemed to assume and shall be liable for loss or damage to products from the time they are placed on to the vehicle to transport them from Octagon Electronics premises unless the Customer has insured the items.

5. Customers are responsible to have someone at the delivery address to sign for and accept the delivery. Cost for re-delivery attempts will be passed to the customers if the delivery address is unattended at the time of delivery.

6. There will be no credit given on order price difference, due to price drops. Please select carefully at the time when you place your order. Product returned for credit/refund is not possible on our store. We may offer a credit with maximum 30% restocking fee on some special circumstances.

7. Any incorrect, missing or damaged items received must be reported to Octagon Electronics within 24 hours of you receiving the delivery. This can only be done by Phone.

8. If item(s) received is not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.

9. Octagon Electronics owns the title of any extra goods shipped with your order that have been dispatched in error.

10. Cancellation of orders should be done within 24 hours by phone and are subject for Octagon's approval .

11. Cancellation for assembled system orders will incur a 30% cancellation fee. This is to reflect the labour cost and depreciation for the used parts.

12. If requested by Octagon Electronics, the customer may be required to provide information for any monetary refund or cancellation. This information may include member's names, address, home phone, work phone, credit card details and other relevant information required by Octagon Electronics.

Insufficient or incorrect information may delay the refund or cancellation, Octagon Electronics is not to be held responsible for any delays according to clause provided by Octagon Electronics. Any attempt to cancel an order must be made as soon as possible. Cancellations after the despatching will result in the customer having to pay for the shipping fee and handling charges.

13. Customer has the right to reject the goods if its package is damaged

REFUND / EXCHANGE POLICY 

1. Refund will be authorised strictly within 7 days and after 7 days no immediate exchange

   or refund will be given.

2. Immediate replacement will also be subject to internal stock and manufacturer availability.

3. We have the right to refuse a refund/exchange when items:

•  Are Incomplete or Missing any parts
•  We are not entitled to a refund if you simply change your mind
•  Are not return in their original packaging
•   Show signs of physical damage to itself or its packaging
•   Are returned without original invoice or receipt
• Has been opened such as software, toner/ink cartridges, CD/DVD and storage media

4. We cannot accept a return of software under any circumstances.

PRODUCT RETURN 

 1. We do not provide refund due to change of mind, unless the product is Dead On Arrival (DOA).

2. At our discretion we may refund with 20% restocking fee less shipping and will only be accepted within 7 days after customer receiving the goods. Customer needs to obtain Return Authorisation (RA) number and must be shipped    within 3 working days after RA number issued.

3. Shipping and handling costs are not refundable.

5. Special Orders : If we make an order on your behalf for a special product, refund or exchange is not applicable. 

5. If customer receives any incorrect or damaged product, please contact Octagon Electronics customer service via e-mail or telephone within 24 hours after receiving the goods. Once verified, the product will be replaced/exchanged and we will reimburse the cost of returning the goods by Registered Australia Post. Please note that customer will be held responsible for any freight charges incurred for returning the product if the product found to be not faulty or correct or as per description.

6. Please do not open the sealed package for any incorrect product received. Any attempt to use the incorrect product will be considered as a substitute for the actual item that was ordered and no further claim can be raised thereafter.

7. Customer is required to obtain a RA number prior to returning any goods and must be shipped within 3 days after RA number is issued.

8. For DOA product, please do not use the product and ensure to return the goods with complete content as well as packaging and in original condition, failure to do so may result DOA being rejected and item will be processed as warranty.

 9. Customer is required to obtain a RA number prior to returning any goods and must be shipped within 3 days after RA number is issued. RA number can be obtained by emailing us  at online@octagon-electronics.com. Please include invoice number, product model and serial number with fault description of the product.

10. For standard stock orders we provide a refund, credit or exchange if the product is:

• Dead on arrival, Damaged in transit or Incorrectly Shipped in its original packing within 7 days of the shipped date.

  Dead on arrive condition is according manufacturer’s standard. If you return a product because it is DOA (dead on arrival) but we find that the product is in full working condition or any defects or damage were caused after you took receipt of the product, we will return the goods via COD(Cash On Delivery), standard postal charges will be payable at the receiving end. 

• Unopened product in its original, unopened and undamaged packaging within 7 days of the shipped date. A restocking fee of 30% may apply at the discretion of Octagon electronics and subject to duty manager approval.

11. You will need to package the product well for return. We will not pay for any cost associated with a customer-initiated return of unopened product. Credit will be issued for the original purchase price less any associated freight costs .

12.We cannot accept a return of software under any circumstances. Any software can not be refunded, due to the exposed license key on the exterior of the product.

PICK UP

1. Octagon Electronics does not charge additional fee for pick up. It is always free!

2. Pick up is available after receiving an e-mail confirmation from us.

3. Customer wishes to pick up an on-line order is required to provide us with a valid photo ID.

4. For credit card payment, customer is required to present the card at the store and payment will be processed over the counter. (credit surcharge may apply)

Liability

In no event Octagon Electronics shall be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever, even if Octagon Electronics has been previously advised of the possibility of such damages, whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, liability to use, or performance of the information, services, products, and materials available from this site.  These limitations shall apply not withstanding to any failure of essential purpose of any limited remedy. Because some jurisdictions do not allow limitations on how long an implied warranty lasts,  the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.

Retention of Title

The title to the products will pass to the Customer when payment in full for the Products has been received by Octagon Electronics. Until the Customer has paid to Octagon Electronics the full purchase price:

Customer shall hold the Products as bailee for Octagon Electronics.

1. The Products shall be stored at the Customer's risk, and in such manner that they are readily distinguishable from other products owned by the Customer or other persons.

2. The Customer shall indemnify Octagon Electronics against any claim, action, proceeding, damage, loss, costs, expense or liability whatsoever, arising out of the possession, use or disposal of the Products by Octagon Electronics, or repossession or attempted repossession by Octagon Electronics.

3. Any sale of the Products shall be effected as bailee for Octagon Electronics, and the proceeds of such sale shall be held on trust for Octagon Electronics. The proceeds of such sales must be held in a separate account or otherwise clearly identified in the books and records of the Customer.

4. The Customer shall permit Octagon Electronics to inspect the Products, and the records and books of the Customer to the extent that they relate to the Products.

5. Reserve right of entry to inspect or recover goods owned by Octagon Electronics, wherever they are located.
